Nebraska Sheriff files lawsuit to supress votes and deny patients access to medical cannabis




Lancaster County Sherrif Terry Wagner has filed a lawsuit in the Nebraska State Supreme Court to remove ballot access for the Nebraska Medical Marijuana Initiative, which would allow safe access of cannabis for the state's most vulnerable residents


Cannabis activists in Nebraska submitted nearly 200,000 signatures to allow medical marijuana to have ballot access in the upcoming election, far exceding the 121,669 required.

On Thursday, Secretary of State Bob Evnen rejected Sheriff Wagner's arguments that the ballot access measure causes "confusion" and "creates doubt about what will be authorized after the election." The following day, Tyrant Wagner filed a lawsuit to remove the Nebraska Medical Marijuana Initiative from the ballot on November 3rd, disallowing voter's choice to have their voices heard regarding cannabis access laws.

The Nebraska Medical Marijauna Initiative states:

  • adults 18 years of age or older who have a serious medical condition to use, possess, purchase, and produce marijuana;

  • minors under the age of 18 with the permission from a parent or a legal guardian and upon the recommendation of a licensed physician or nurse to use marijuana for a serious medical condition; and

  • the state legislature to pass laws that regulate entities that provide marijuana or marijuana-related products and promote the safety of individuals who use medical marmarij.


The State Supreme Court has agreed to hear the dispute, and arguments are expected to begin on Thursday. The deadline for ballot access is September 11th, leaving little time for the supreme court to make a judgement.

This is the latest attempt of Nebraska Senators Anna Wishart and Adam Morfeld to legalize medical cannabis for Nebraska patients.

Sen. Morfeld tweeted, “I asked Sheriff Wagner how many people had died from drug and alcohol overdoses in his career?” the senator tweeted. “He said too many to count. How many from marijuana? Zero.”

In an email to supporters, Nabraskas for Medical Marijuana said "Common sense, compassion, and the law are on our side."
