John Howard McMahan, 28, of Knoxville, Tenn was stopped by Palm Beach FL policethis week. As indicated on the police report, deputies reported a strong odor of marijuana coming from the vehicle. The report also indicated the McMahan & his passenger were noticeably nervous. It's difficult not to be knowing that 1,800 peaceful citizens daily are arrested for non-violent drug crimes.
The young man's fear then became a reality when deputies ordered hm to step out of his vehicle as they conducted a search. Inside they found a mason jar of cannabis and asked the driver if he had a medical marijuana card. In the state of FL, cannabis is legal for medical patients who are under direct recommendation from a doctor and who have paid the state to obtain a license. But John, being from Tennesee could not obtain a medical cannabis card without FL residency and was arrested at the scene.
He was charged with possession of marijuana and possession of drug paraphernalia, and taken to the Palm Beach County Jail. He was released Friday, and is scheduled to appear in court Jan. 8.
